Expert mission on Geographical Indications (GIs), 12-13 December 2006, Bali
At the occasion of a two-day seminar on GIs organised with the support of the French Embassy In Indonesia, the CIRAD, the Indonesian Coffee and Cocoa Research Institute (ICCRI) and the Dinas Perkebunan of the Province of Bali, Stephane Passeri, ECAP II Programme Administrator, was invited to present the current situation and expected developments of GI protection in ASEAN countries.

In connection with the 60th anniversary of HM King Bhumibol Adulyadej's accession to the throne and on the occasion of the 9th anniversary of the Thai Central Intellectual Property and International Trade Court (CIPITC), the CIPITC organised a symposium supported by ECAP II, JETRO Bangkok and BSA. This event, held in Bangkok on 30 November to 1 December 2006, titled “Balancing IPR Protection: Right holders and Public Interests᾿, focused on Thai & international experiences and latest developments on IPR enforcement.

Enforcement of Intellectual Property Rights: Singapore
Intellectual Property Rights can be enforced by the rights holders themselves via civil actions. In addition, criminal enforcement activities (e.g. raids on software pirates) are carried out regularly by the Intellectual Property Rights Branch of the Criminal Investigations Department of the Singapore Police Force.

The only intellectual property law in force in the Lao PDR at the moment is a Prime Minister’s Decree on Trademarks No 06/PM (1995) and a Prime Minister’s Decree on Patent, Petty Patent and Industrial Designs No 01/PM (2002).

On 5-6 September 2006, Vietnamese and International experts Dr. Silke von Lewinski, Head of International and European Copyright Law Department of Max Planck Institute for Intellectual Property in Munich, Germany and Mr. Ang Kwee Tiang, Regional Director of International Confederation of Societies of Authors and Composers (CISAC) in Singapore presented an overview of the Collecting Management of Copyright and Related Rights systems in Europe, Vietnam and ASEAN.

Enforcement of Intellectual Property Rights: Malaysia
Intellectual Property Rights in Malaysia may be enforced by instituting legal proceedings. All Malaysia IP Laws provide for civil action to be taken by the IP owners themselves. The remedies available are damages, injunctions, accounts of profits etc.

Dr Peter Ganea from the Max Planck Institute for Intellectual Property carried out a mission to Vientiane and Phnom Penh to assess current enforcement structures and to provide recommendations with regard to international standards.
Mr Fabrice Mattei from Rouse & Co International Ltd in Bangkok joined Dr Peter Ganea for the Cambodian activity which also comprised the drafting of guidelines on enforcement.

Ms Bustin from the French Office for Plant Varieties Protection (CPOV) provided comments on the Vietnamese draft Regulation on Plant Varieties protection. The new Vietnamese IP law entered into force on 1 July 2006.

The Lao-American College in Vientiane was selected to conduct an English-language training session for 30 Laotian officials from the Science, Technology and Environment Agency (STEA) and other IP-related administrations.

Translation of the Thai GI Gazette, Volume 2, No. 1
ECAP II translated the second Geographical Indications (GI) Gazette from Thai into English. This Gazette serves as a medium for publishing new GI applications before their final registration, following a 90-day opposition period. The new volume of these new applications is available on the ECAP II website

Handbook of Indonesia IPR laws in Indonesian language
ECAP II sponsored the publishing of 1 000 handbooks containing Indonesian IPR laws currently in force (in Indonesian language). This forms part of the DGIPR’s efforts to disseminate IPR information to enhance awareness in Indonesia. The handbook is now available at the DGIPR.

Translation of guidelines for courts
ECAP II assisted the Supreme People’s Court of Vietnam in the drafting and translation into English of guidelines for the courts on how to use and implement TRIPS-conform remedies in accordance with the new Civil Procedural Code 2004.

ASEAN DVD video on IPR protection
The first ASEAN DVD
video on IPR protection was produced within the framework of the ECAP II co-operation programme with ASEAN countries. The DVD aims at raising awareness on intellectual property rights and represents a comprehensive, yet easy to understand, overview of all aspects of intellectual property: patents, trade marks, plant varieties, geographical indications, industrial designs and copyright.
